Sale or purchase of used machinery

In the case of purchase and sale of used or non-used machinery, paragraph 1 of Article 72 of Legislative Decree 81/2008 provides for the certification of conformity of the machinery by the person who sells it: Anyone who sells, rents or grants for use or financial leasing machines, equipment or tools built or put into service outside the provisions of Article 70, paragraph 1, certifies, under his own responsibility, that they comply, at the time of delivery to the person who purchases, receives for use, rental or financial leasing, with the safety requirements set out in Annex V. SITUATION 1 Exchange of used machinery for new purchase According to art. 11, paragraph 1, of Presidential Decree 459/96 (still in force as provided for by art. 18 of Legislative Decree 17/10), the user (employer) who sells a used machine in exchange for a new purchase, must certify at the time of sale that the machine complies with the previous legislation. Art. 72 of Legislative Decree 81/08 has integrated this precept by specifying that the certification concerns conformity to the safety requirements set out in Annex V. However, in the case of "exchange for new purchase" there is no transfer to a direct user and there is therefore no intention to re-market a machine that presents any deficiencies. On the basis of these considerations, it is believed that the obligation to certify the conformity of the machine falls to the reseller of the machine. Therefore, during the assessment, compliance with this obligation by the reseller will be verified. In the deed of sale, in relation to used machinery and in the case of machinery with possible safety deficiencies, it is advisable to specify: - type of machinery and model - serial number - name of the manufacturer - wording "The machinery cannot be reintroduced onto the market in its actual condition; this is only possible following adaptation to safety standards". SITUATION 2 Sale of used machinery to another direct user The owner of a machine (for example the employer) who sells it to a direct user (for example another employer) must always certify the conformity of the machine with the safety requirements set out in Annex V. This obligation also applies to those who grant the machine on a work account, rent it or lend it for use. SITUATION 3 Sale of used machinery for sale The owner of a machine, who supplies it to a third party with a power of attorney for the sale of the asset, is required at the time of sale to certify the conformity of the machine with the safety requirements set out in Annex V. In the case of exchanging the machine for a new purchase (or transferring it to a person who will not put it into service, but who will put it back on the market after having reconditioned it), the document cited above allows the seller not to certify the conformity of the machine, moving this obligation to the time of the re-marketing of the reconditioned machine, while the ministerial circular provides that in any case the seller certifies that the machine complies with the previous legislation. TECHNICAL NOTES: On the subject, ruling of the Criminal Cassation Court, section III, of 1 October 2013, n. 40590 specifies that the manufacturer is not liable in the event that he sells a machine that does not meet the necessary safety requirements if the machine is not to be used subsequently, but only subjected to repair and overhaul before being placed on the market: "If the sale of the non-compliant machine is carried out solely with the intention of not putting it into circulation but of entrusting it to a person (the transferee) for repair, the regulatory provision can no longer be applied". "Indeed, it is a principle of reasonableness, not separated from a general economic rule, that underlies the contested rule, in the sense that, while it is true that the use of non-compliant machinery is prohibited, with the consequence that the sale of such products is, as a rule, prohibited given the consequentiality and normality of the use of the machine in the production cycle, with a view to the passage of the industrial product to the next economic phase (use), where this last step does not exist (as in the case of the machinery being stored at a company specialized exclusively in repairs for compliance with well-specified tasks that inhibit subsequent use mediated through the seller at the origin), the sale of a machine cannot be considered prohibited because it has a well-defined purpose, without any provision for use". write a description for this card and include information of interest to site visitors. Regulatory framework

If you sell a Safety Component, not just a sheet of steel, you must provide with it the Declaration of Conformity stating that you have designed it according to the Machinery Directive. You must also provide the Use and Maintenance Manual, which will depend on the type of protection.
